CONDITIONS OF SALE

By making a purchase from Food of the Gods by telephone, email or this website www.food-of-the-gods.com, you are agreeing to be bound by the following terms and conditions. From time to time we may update these terms and conditions and it is your responsibility to check these terms and conditions prior to making any purchase with us.

ORDERING AND PAYMENT

You may place an order via the website, over the telephone or email. We accept payment via bacs, bank transfer, cheque, debit and credit cards over the telephone (we may request confirmation via email where necessary) and our website transactions via Stripe and Paypal. All card payments are validated and authorised prior to completion and despatch of your order and we cannot accept orders for payments which are not authorised at time of processing the order. You may place an order and arrange payment in advance where feasible. Payments are processed using industry standard SSL to allow encryption of credit card details. All prices shown are inclusive of VAT where applicable at current rates. Prices are correct at time of going to press but are subject to market fluctuations. Delivery charges apply to all orders. Full payment by cheque, bacs, credit or debit card must accompany all orders.

GUARANTEE

It is our policy to ensure that all goods are supplied in perfect condition. However, should any our products be damaged, or unsatisfactory, we will replace it provided you notify us within 48 hours of receipt via telephone on 01342 318883 or email to gods-gift@food-of-the-gods.co.uk. If the same gift or hamper is not available, we will replace it with a gift or hamper of equal or higher value. This does not affect your statutory rights.

CANCELLATION, RETURNS AND REFUND POLICY

We fully comply with distance selling regulations and thrive to be fair and treat our customers how we like to be treated our selves. Under the UK Distance Selling Law it’s a customer’s statutory right, to be able to cancel/return any order made online. You enjoy a right of having a cooling off period of seven (7) working days from the date of delivery in which to return an item for any reason. This means that we will refund the total cost of the product and the delivery charges in full if you choose to cancel your order for any reason provided that you comply with the following :-

1. You notify us of your cancellation in writing by letter or email at this address within 7 working days of delivery.

2. The goods remain unused and all items / parts within the contents remain unopened and in the same condition.

3. The recipient or you take reasonable care of the goods until collected by our courier where arranged or

4. The goods and contents must be returned in same condition as supplied, un-used and in the original/appropriate packaging at your own cost.

5. Refunds will be issued upon receipt of the goods and all items/contents being intact.

EXCEPTIONS

In accordance with the distance selling regulations, we regret that you may not cancel or return the following:-

1. Fresh food gifts and hampers containing fresh fruit, smoked salmon, meat or cheese.

2. Bespoke gifts and hampers where we have specifically purchased items relating to your order.

3. Large corporate orders.

4. Personalised and branded gifts and hampers.

PRODUCT AVAILABILITY AND GENERAL INFORMATION

All items are subject to availability and in the event of an item(s) being out stock, we reserve the right to replace the item(s) with a suitable alternative of similar value. It is our policy to use quality packaging and presentation materials as reflected in the online catalogue. However, presentation and packaging (hampers, baskets, giftboxes and ribbons) may vary from those illustrated in the photographs due to availability, changes in design and new stock. All giftboxes, baskets and hampers photographed contain only the items listed. Other items and props featured in the photographs are not included. The description ‘Hamper’ is used in the general sense. Vintages of wines may change through the year.

WINES, SPIRITS AND LICENSING ACT 2003

Under the UK Licensing Act 2003, it is an offence to purchase or attempt to purchase alcoholic liquor if you are under the age of 18. You are therefore required to be the minimum age of 18 years to purchase any gift or hamper containing wines and spirits.

DELIVERY DELAYS

We are not responsible for late delivery of any gift and hamper due to:-

1. Incorrect or incomplete delivery addresses.

2. Adverse weather conditions.

3. Delays during transit howsoever caused.

4. Any other cause beyond our reasonable control.

INTERNATIONAL DELIVERIES

All international deliveries are subject to our Couriers terms and conditions and as such cannot be guaranteed. Deliveries will be made subject to anticipated delivery speeds and we cannot be held responsible for delays caused by customs regulations or any other reason beyond our control whilst in transit. We cannot be held responsible for non-delivery of items after an attempted delivery and the recipient not claiming the item from the relevant postal service.

COMPLAINTS

We take our customer service seriously and hope that there is never a need for any complaints However should an issue arise, in the first instance please notify us and submit your complaint in writing to us on 01342 318883 and at gods-gift@food-of-the-gods.co.uk and we will do our utmost to resolve it.

CLAIMS

Claims for damage and breakages must be brought to our attention in writing within 3 days of receipt of goods. In the event of non-arrival, please contact us within 2 weeks of the expected delivery date.
